Working visit to Brazil: AVELife at the Pontifical Catholic University of Rio de Janeiro (PUC-Rio)

The AVELife Institute continues to expand the horizons of international scientific and technical cooperation. As part of a working visit, our representative Demchenko A. M. visited one of the leading institutions of higher education and research centers in South America — the Pontifical Catholic University of Rio de Janeiro (PUC-Rio) in Rio de Janeiro, Brazil.

The main goal of the visit is to exchange experience in the field of high technology, expand scientific ties, and discuss issues of commercialization and legal protection of intellectual property in the global market.

Science without Borders and Inventor Status: Lessons from the USPTO

During international meetings and scientific reports, the question often arises about the rights of the authors of developments after the transfer of patent rights to commercial partners.

Against the backdrop of the visit to PUC-Rio, the comment regarding the legal status of the co-developers (in particular, Anatoliy Mykhailovych) and cooperation with the company VieriDem becomes even more relevant:

  1. Authorship remains with the scientist: Even in the jurisdiction of the US (USPTO), the transfer of property rights (assignment) to a legal entity (Veridam) changes the owner of the patent, but does not cancel the status of the inventor. The individual who participated in the creation of the technical solution remains its author forever.
  2. Rights and Restrictions: The patent owner has the right to prohibit others from making, using, or selling the invention for commercial purposes. However, writing scientific articles, reports, or publications about an invention that has already been made public is not an infringement.
  3. Increasing the significance of the development: Public coverage of the invention by the author in international academic collages (such as PUC-Rio) is not only legally valid, but also increases the capitalization and recognition of the technology in the world.

Results and prospects

The visit to PUC-Rio in Rio de Janeiro confirms that Ukrainian scientific solutions are of high interest in the international community. The AVELife Institute will continue to uphold the principles of open scientific dialogue, legal literacy, and international partnership.
